1. Introduction and Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the Gwin PH digital entertainment platform and associated services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- Age Restriction: Use of this Platform is strictly limited to individuals who are 21 years of age or older. By using the services, you warrant that you meet this age requirement.
2. Your Account and Responsibilities
Account Registration and Security
You must provide accurate and complete information when registering an account. You are solely responsible for maintaining the confidentiality and security of your account credentials (username and password). Gwin PH is not liable for any unauthorized use of your account.
Permitted Use
The Platform services are provided for personal, non-commercial entertainment purposes only. You agree not to use the Platform for any unlawful activity, fraudulent transactions, or disruptive behavior towards other users or the Platform’s systems.
3. Digital Entertainment Services and Performance
Service Availability
Gwin PH strives to ensure continuous access to the Platform. However, we do not guarantee uninterrupted availability. Access may be suspended, restricted, or terminated for maintenance, repair, or due to factors outside our control (e.g., network congestion, third-party payment system failures).
Data and Processing Times
Any displayed data, including but not limited to, average transaction processing times and community membership counts, are provided as verified statistics based on internal audit data. These figures are informational and do not constitute a guarantee of future or specific transaction speeds.
4. Intellectual Property Rights
All content, features, and functionality on the Platform, including text, graphics, logos, and software, are the exclusive property of Gwin Interactive Inc. and are protected by Philippine and international copyright laws. You are prohibited from reproducing, distributing, or creating derivative works from any Platform content without prior written consent.
5. Limitation of Liability (Disclaimer)
The Platform and all its services are provided on an “as is” and “as available” basis. Gwin PH (Gwin Interactive Inc.) shall not be liable for any indirect, incidental, special, or consequential damages resulting from:
- Your use or inability to use the Platform.
- Any unauthorized access to or alteration of your transmissions or data.
- The conduct of any third party on the Platform, including payment providers.
- Delays in processing, even if those delays exceed the typical median processing time published on the site.
6. Amendments and Updates
Gwin PH reserves the right to modify or replace these Terms at any time. When material changes are made, we will notify users through an updated notice on the Platform or via email. Your continued use of the Platform following any such changes constitutes your acceptance of the new Terms.
